What Khartus does
Khartus reads the documents in a file, sets out where the other side's account is open to attack and where your own has gaps, calculates deadlines with a full audit trail and prepares draft letters. The price is 350 euros per file plus VAT, one-time. Access to a file runs for 360 days; export is possible at any time. No subscription, no recurring charges. Every qualified lawyer in the firm receives their own account at no extra cost.
A tool, not a legal service
Khartus works in the hands of a qualified lawyer. Legal assessment, decisions and all dealings with clients, opposing parties and courts remain solely theirs. Khartus provides no legal service within the meaning of § 2 RDG, does not appear before third parties and conducts no proceedings. Criminal and custody matters are excluded.
Material for review, not results
Khartus prepares. What it produces — findings, deadline figures, letters — is material for review by the qualified lawyer, not determinations and not recommendations to be relied upon. What is owed is careful preparation, not its result. Whether any output is suitable in a given case is for the lawyer alone to judge. The calculation shown serves that review; it is not proof that a figure is correct. The firm's own deadline control remains unaffected.
Who may use Khartus
Khartus is available to qualified lawyers and their firms. Accounts are created solely through an access code issued by us. Staff members of a firm receive their accounts from the lawyer under whose responsibility they work. Accounts are personal and non-transferable.
Client data
The file belongs to the firm. We process client data solely on instruction under a data processing agreement pursuant to Art. 28 GDPR and are bound to confidentiality under § 43e BRAO; the same applies to everyone we engage (§ 203(4) StGB). Sub-processors engaged are named in the data processing agreement. Export and deletion are possible at any time.
Term and withdrawal
There is no subscription; billing is per file. The agreement may be ended at any time without reason, effective at month end. Termination applies to the entire firm; there is no claim to later return. Files already created remain available until their access period expires. If a file cannot be handled because it falls outside the scope of service, the amount is refunded.
Who decides
Every legal assessment, every decision and all dealings with the outside world rest with the qualified lawyer. They check, take responsibility for and sign what they use. Khartus does not appear before third parties, gives no recommendations and makes no choice that binds the lawyer. Before first use, every account confirms this allocation of roles once.
Liability
No liability is accepted for damage arising from using material without review — review is the purpose of the material. Otherwise liability for intent and gross negligence follows the statutory provisions. For slightly negligent breach of an obligation essential to the proper performance of the contract, liability is limited to the foreseeable damage typical of such contracts, at most to the fee paid for the file concerned. No further liability for slight negligence exists. Liability under the German Product Liability Act and for injury to life, body or health remains unaffected.
When Khartus does not work
Distinct from this is the case where a file cannot be handled at all — because it falls outside the scope of service or a technical fault prevents processing. The fee for that file is then refunded. An output that does not convince is not such a case.
